Article 1
Subject Matter of the Attorney’s General Terms and Conditions
1.1 These General Terms and Conditions of the Attorney constitute the business terms of the law firm Olujić & Partners, seated in Split (hereinafter: the Attorney), governing the mutual rights and obligations of the Attorney on the one hand and the users of the Attorney’s services (parties / Client / заказodavac / grantor of power of attorney — hereinafter collectively and individually: the Client) on the other hand, and relating to the provision and use of the services provided by the Attorney (hereinafter: the Services).
All mutual relations between the Attorney and the Client that are not specifically regulated by these General Terms and Conditions shall be governed by the Civil Obligations Act and all other applicable regulations of the Republic of Croatia.
1.2 These General Terms and Conditions also regulate the manner in which the Client and the Attorney establish a contractual relationship regarding the services provided by the Attorney. The Offer, the Instruction, the Representation Agreement, and these General Terms and Conditions together constitute the Services Agreement within the meaning of these General Terms and Conditions and form an integral part thereof. If the Client has also issued a power of attorney for certain services, the Attorney’s General Conditions of Representation stated in the power of attorney and other documentation to which the Instruction may refer shall also apply; the same shall be binding on the Client and shall form an integral part of the contract concluded with the Client.
The contract concluded by the Attorney and the Client regulates their mutual relations (hereinafter: the Contractual Relationship).
1.3 For the purposes of these General Terms and Conditions, the following terms shall have the meanings set out below:
- Attorney – refers to Olujić & Partneri d.o.o. Law Firm, i.e. attorneys Domagoj Olujić, Iva Olujić, and Katarina Prgomet, with the registered office of the law office in Split, Narodni trg 2, OIB: 18702461188.
- Client – a legally capable natural or legal person who has ordered the services provided by the Attorney.
- Instruction – an oral or written order or request, or an order issued or delivered by electronic communication, by which the Client instructs the Attorney to perform a service or services under the terms and on the basis of the Offer and these General Terms and Conditions, thereby accepting them and undertaking to pay the price stated in the Offer; a power of attorney issued by the Client to the Attorney shall be deemed an instruction or order to perform the service, and for the purpose of calculating the value of the Attorney’s services in such case, these General Terms and Conditions and the Attorney’s General Conditions of Representation shall apply.
- Offer – a written or oral response of the Attorney to the Client’s inquiry or request, containing an exact or more detailed description of the service to be provided to the Client or referring to services performed by the Attorney in accordance with the regulations governing the provision of legal services, and containing the price or the method of determining the price and the deadline for performance of the Service, with reference to these General Terms and Conditions.
- Contract – a contract for the provision of services concluded between the Attorney and the Client orally, in writing, by email, telephone, fax, or electronically (e.g. by SMS, Viber, etc.), of which these General Terms and Conditions form an integral part, unless wholly or partially excluded by the contract; the contract may also be concluded at a distance.
- Service – a service in the field of legal services or law, or any other service provided by the Attorney, stated in the Offer and ordered by the Client, i.e. for which a Contract has been concluded.
- Request – any oral, written, or electronic request/inquiry of the Client submitted to the Attorney for an Offer.
- Price – a fixed amount the Client is obliged to pay the Attorney for the provided service pursuant to the Offer, or an amount that can be calculated based on the elements contained in the Offer, whereby the final price depends on the scope of the service to be performed by the Attorney for the Client, as more precisely specified in the Offer itself.
- Deposit – an amount that, in certain cases, the Client pays before the commencement of the Service; upon payment of the Deposit, the Contract between the Client and the Attorney shall be deemed concluded.
